Our Family and Divorce Law Firm’s Primary Practice Areas

Our Ardmore divorce lawyers have experience in all areas of divorce law. Legal issues we help you resolve related to your divorce include, but are not limited to:

Divorce

Divorce is the legal process to end a marriage. Even when spouses agree to end the marriage, the divorce process can be complicated and emotionally draining. Our Ardmore divorce lawyers provide legal advice and support to help you through the legal issues involved in a divorce. We advocate for your best interests to help you secure a divorce settlement that gives you the best footing for a secure future.

Child Custody

Custody refers to a parent’s legal rights. Child custody can be one of the most contentious issues in a divorce case. Our Ardmore child custody lawyers work with you to ensure your children are protected now and in the future. We negotiate parenting plans and visitation schedules, protecting your parental rights and children’s well-being.

Child Support

Even though parents separate and divorce, they must continue supporting their children financially. Child support is government-mandated financial support paid from one parent to another. Our Ardmore child support lawyers work to ensure you are paying/receiving a fair amount of child support based on the Virginia child support guidelines and the facts of your case.

Judgment Modification

A divorce may be final, but some issues related to your divorce may change. A change in circumstances may require a judgment modification for alimony/spousal support, child custody, or child support. Our Ardmore judgment modification lawyers help you petition the court for changes and gather the evidence necessary to prove a substantial change in circumstances justifies modifying a court order.

Property Division

A couple must decide how to divide their marital assets when they divorce. Separate property is not subject to property division. If a couple cannot decide how to divide their property, a judge will do it for them based on what is fair and equitable. Our Ardmore property division lawyers work with you to resolve disputes and obtain a fair property division settlement.

How Do I Seek a Divorce in Ardmore, VA?

Virginia has residency requirements for a divorce. One spouse must be a Virginia resident for at least six months before a divorce is filed. The spouse filing for divorce is the plaintiff, and the other spouse is the defendant.

Virginia has several fault grounds for divorce, including:

  • Adultery
  • A spouse is convicted of a felony and sentenced to a year or more in jail/prison
  • Desertion of abandonment
  • Cruelty
  • Sodomy outside of the marriage

If you file for divorce on fault grounds, there must be evidence proving your spouse committed the alleged wrongful acts. Virginia also has no-fault divorce grounds, but you must live separate and apart from your spouse for at least one consecutive year. If you do not have children with your spouse, you and your spouse can agree to shorten separation time to six months.

How Will My Property Be Divided in a Divorce in Virginia?

Virginia follows an equitable distribution model for property division. Marital assets are divided based on what is fair and equitable. However, “fair and equitable” does not always mean equal. A court can divide marital property unequally.

If you and your spouse disagree on how to divide your marital assets, a judge considers numerous factors to determine what is fair and equitable. Those factors include:

  • The duration of the marriage
  • Each spouse’s debts and liabilities
  • Applicable tax consequences
  • How the property was acquired and used
  • Each spouse’s mental and physical health
  • The degree to which a spouse contributed to acquiring assets, including contributions as a homemaker or other non-monetary contributions
  • Whether a spouse is largely at fault for the breakup of the marriage

Judges may consider other factors when dividing marital assets. Our Ardmore divorce lawyers work with you to identify all property subject to division while protecting your separate assets from being divided with your spouse.

Who Will Get Custody of Our Children After the Divorce?

A child is presumed to benefit from a continuous, close relationship with both parents. Therefore, barring evidence to the contrary, courts prefer parents to share parental responsibilities. Parents are encouraged to develop a parenting plan that gives the child ample access to both parents.

Courts decide child custody based on what is in the best interest of the child. Even when parents propose a custody agreement, a judge reviews the agreement to ensure it is in the child’s best interest.

The Virginia Code provides factors for judges to consider when evaluating a child’s best interest. However, judges may consider all factors they believe are relevant to protecting the child’s best interests. Our legal team diligently works to protect your children’s best interests while negotiating a parenting plan that meets the family’s needs.
